What are California’s penalties for a commercial DUI?
If the result of a
chemical test, whether a blood or breath test, show a blood alcohol content (BAC) level
of 0.04% or higher, the commercial vehicle driver may have his or her
driver’s license suspended by the Department of Motor Vehicles (DMV).
The driver’s license can be suspended for 4 months for a first offense
and a year for more than 1 offense within a 10-year period.
Under California law, anyone charged with a first-time DUI is prohibited
from operating a CMV for at least one year. Refusal to submit to a chemical
test while driving a CMV can result in licensing sanctions because of
California’s implied consent law. Commercial vehicle drivers convicted
of a DUI charge may face the loss of his or her job if a commercial driver’s
license is required. For CMV drivers who are tested to have a blood alcohol
content level greater than 0.01% are considered out of service for 24 hours.
