Police Brutality Fighting for Your Rights & Freedoms

Attorney for Police Misconduct in Ventura

Mistreated by Law Enforcement Officers?

At Wilfert Law, P.C., we are absolutely committed to protecting the rights of individuals who have been unnecessarily mistreated or abused by law enforcement officers. In our society, we hold law enforcement officers to the highest standard and place our trust in them to protect us and do what is right.

While the vast majority of officers act in a manner befitting that trust, we have found that there are a few rogue officers who have taken their position and the public trust for granted.

As a former Police Officer and Deputy District Attorney, I find this deviation to be unacceptable given the faith we put in the position. At Wilfert Law, P.C., we locate and identify these betrayals of the public confidence and hold the agency accountable.

Did a cop misuse power during your arrest?

Police, understandably, are allowed to use a degree of reasonable physical force to make an arrest. Often the public will focus on the degree of force used in determining if there has been a misuse of power. We have found, while this is often the most obvious area that is scrutinized, it is not the only one that should be evaluated.

There are many other facets to the interaction between law enforcement and citizens that must be assessed. For example, the Courts have recognized times in the past when law enforcement officers would cancel medical treatment for suspects in an effort to "punish" them for their behavior.

At times this has led to an aggravation of injuries that could have been avoided. In some of these cases, the Court has held the law enforcement agency liable for those damages.

Our legal team is comprised of former police officers who have seen misconduct and even brutality firsthand. We find these police actions particularly hypocritical and frustrating, so we do everything we can to hold officers accountable for their faults.

How much force can a police officer use when arresting a suspect?

Police may be punished for using any more force than is reasonably necessary to make an arrest.

Here are some common examples of excessive force:

  • Repeatedly using a weapon against a suspect that is already restrained
  • Using physical force on a suspect that is not resisting arrest
  • Using a weapon against an unarmed suspect
  • Using physical force or the threat of physical force to coerce a suspect into confessing

When determining if force was excessive, the court may factor in the severity of the crime, the threat posed by the suspect, and the circumstances of the arrest. Our police misconduct attorneys can help you compile the right evidence to prove the officer's misconduct.

It is imperative that you act immediately as these claims have strict time constraints. Also, the longer you wait, the more difficult it will be to obtain appropriate documentation of the injury. Our legal team can advise you on how to best go about the process.
