When Is Hit and Run a Felony?

The severity of a hit and run charge in California depends on the damages and injuries that result. You may be charged with a misdemeanor or a felony, depending on the specifics of the accident:

  • Misdemeanor Hit and Run: If a driver only caused property damage, they would likely face a misdemeanor charge. The person who is at fault will then face a maximum six months of jail time and/or must pay a fine of up to $1,000. They may also face three years of probation, restitution charges, and two points on their driving record.
  • Felony Hit and Run: If a driver caused injury or death in a hit and run accident, a felony charge is made against the liable party. Conviction for felony hit and run is punishable by incarceration in state prison for a maximum of 4 years and fines up to $10,000.
