California Bribery Laws & Penalties

A bribe occurs when a public official corruptly makes a decision or intervenes on behalf of someone in exchange for money or something of value. Bribery can be prosecuted under both solicitation of a bribe and offering a bribe to a public officer or employee.

The law of bribery in California spreads through the following laws:

  • Bribery involving California legislative officers
  • Bribery involving executive and ministerial officers and public employees
  • Bribery involving supervisors and public corporations
  • Bribery involving judicial officers and jurors
  • Bribery involving witnesses
  • Commercial bribery

Bribery is considered a felony in California, punishable by a prison sentence between two and four years. Additionally, a convicted offender may also have to pay a restitution fine if a bribe between $2,000 and $10,000 was not actually received or if the bribe was actually received.

However, bribing a ministerial officer in an amount less than $400 is considered a misdemeanor, resulting in a maximum jail sentence of one year.
