Murder Laws & Penalties in California
There are two types of murders in California: first-degree murder and second-degree murder.
First-degree murder is the unlawful killing that is deliberate, premeditated, and willful. Additionally, “felony murder,” which includes any murder that is carried out while committing or attempting to commit another felony offense, is considered to be first-degree murder. This type of murder is punishable by a prison sentence ranging from 25 years to life without the possibility of parole.
On the other hand, second-degree murder does not involve premeditation and deliberation, only malice and acting intentionally. A conviction for this type of murder results in a prison sentence ranging from 15 years to life. If you are convicted of first or second-degree murder and a firearm was used in the commission of the crime, 10, 20, or 25 years could be added to your sentence.
