Penalties for Sexual Battery
Sexual battery can be either a misdemeanor or a felony. Examples of misdemeanor sexual battery include putting your hands on someone else's rear-end without their consent or intentionally fondling someone else's genitals without consent. A misdemeanor is punishable by a maximum county jail sentence of six months and a fine of up to $2,000 – or up to $3,000 if the alleged victim was an employee.
A felony sexual battery charge may apply if the alleged victim was:
- Unlawfully restrained
- Forced to masturbate or touch one of the offender's intimate parts, or parts of another person
- Institutionalize and either medically incapacitated or seriously disabled
- Unaware of the nature of the act due to being fraudulently convinced that the touching was for professional purposes
If you are convicted of a felony sexual battery, you may face a prison sentence of two, three, or four years, a fine of up to $10,000, and registration as a sex offender. If the alleged victim sustains great bodily injury, it is punishable by an additional three to five-year prison sentence.
