Child Pornography Laws & Penalties

To be convicted of a child pornography crime in California, the prosecution needs to prove that you knowingly committed the act and, upon the commission of the act, you knew that the material showed an individual under 18 years old participating or simulating sexual conduct. Most child pornography offenses are considered felonies and require the guilty party to register as a sex offender.

Possession means knowingly possessing or controlling any child pornography which was produced using a person under 18 years of age. The punishment for this offense is a maximum county jail sentence of one year and a fine of $2,500.

On the other hand, a person convicted of transporting child pornography into the state or distributing child pornography to others may be sentenced to one year in county jail and a fine of $1,000. Depending on the circumstances of the case, however, the court may decide to sentence the defendant to up to three years in prison and a $10,000 fine.
