California Penal Code 261: How the Law Defines Rape

California Penal Code 261 defines rape as non-consensual sexual intercourse accomplished through force, threats, fraud, or by taking advantage of a victim who is unconscious or incapable of consenting. Under California law, any penetration satisfies the intercourse element. Physical resistance by the alleged victim isn’t required to establish that an act was non-consensual.

California also recognizes that consent can be withdrawn after intercourse has begun. Once withdrawal of consent is clearly communicated, the other party is legally required to stop. A prior consensual relationship between the parties doesn’t establish consent to any subsequent act.

What the Prosecution Must Prove

To secure a rape conviction, a California prosecutor must prove every element beyond a reasonable doubt: that sexual intercourse occurred; that the alleged victim did not consent; and that the act was accomplished through force, threat, fraud, or by taking advantage of the victim’s incapacity. If any one of those elements can’t be proven, the charge shouldn’t result in a conviction.

California eliminated its separate spousal rape statute in 2021, meaning rape is now prosecuted under PC 261 regardless of whether the parties are or were married and carries the same penalties.
