Sex Crime Charges in California

Sexual Battery in California

Our Ventura Criminal Defense Lawyer is Ready to Fight Tirelessly for You

In California, sexual battery is defined as touching the intimate part of another individual against his or her will and for the specific purpose of either sexual gratification, sexual arousal, or sexual abuse. Unlike rape or sexual assault, sexual battery does not require that the offender engage in actual penetration or sexual intercourse.

If you were recently arrested and charged with sexual battery in Ventura County, Wilfert Law, P.C. understands what it takes to get the most favorable results possible.

Our Ventura criminal defense attorney has been helping clients involved in sex crimes obtain successful outcomes for over a decade. We can investigate your arrest, collect and analyze evidence, and build an effective defense strategy just for you.

Penalties for Sexual Battery

Sexual battery can be either a misdemeanor or a felony. Examples of misdemeanor sexual battery include putting your hands on someone else’s rear-end without their consent or intentionally fondling someone else’s genitals without consent. A misdemeanor is punishable by a maximum county jail sentence of six months and a fine of up to $2,000 – or up to $3,000 if the alleged victim was an employee.

A felony sexual battery charge may apply if the alleged victim was:

  • Unlawfully restrained
  • Forced to masturbate or touch one of the offender’s intimate parts, or parts of another person
  • Institutionalize and either medically incapacitated or seriously disabled
  • Unaware of the nature of the act due to being fraudulently convinced that the touching was for professional purposes

If you are convicted of a felony sexual battery, you may face a prison sentence of two, three, or four years, a fine of up to $10,000, and registration as a sex offender. If the alleged victim sustains great bodily injury, it is punishable by an additional three to five-year prison sentence.
